The plaintiff in error, Akin & Dimock Oil Company, defendant below, was charged in the county court of Cotton county, Oklahoma, with the offense of polluting a stream, Beaver Creek, a habitat of fish, by permitting deleterious substances, to wit, crude oil, to flow therein by way of Goodin Creek from defendant's two oil wells, No. 6 and No. 2, thus endangering the lives of the fish and other wild life, all in violation of law, Title 29, § 273...
