Plaintiff seeks to recover damages resulting from a fall sustained in the Penney Company store at or about 1:00 o'clock P. M. on April 21, 1951. Plaintiff's injuries consisted of the fracture of the second metatarsal bone of the left foot, necessitating the application of a cast.
