The defendant, Eddie Fischer, was charged by an information filed in the district court of Pottawatomie county with committing the crime of attempted rape, "upon one Pamela Sue Leeson, a female person of the age of four years"; was tried; convicted; and pursuant to the verdict of the jury was sentenced to serve two years in the State Penitentiary; and has appealed.
