Defendant has appealed from a judgment entered against him for the recovery of money and also from an order denying his motion under section 473 of the Code of Civil Procedure to vacate the judgment on the grounds that it was taken against him through his mistake, inadvertence, surprise and excusable neglect.

The complaint herein, filed in September, 1947, was based upon a promissory note executed and delivered by defendant to one Sophie Lieberman...
