This is an appeal on questions of law from a judgment of the Common Pleas Court.

In order to carry to completion plans for the construction and improvement of U. S. Route No. 25, generally known as the Dixie highway, at a point just south of Bowling Green, Ohio, the Director of Highways, on August 21, 1950, pursuant to statutory provision filed a resolution and finding declaring it necessary to appropriate certain lands belonging to appellants....
