This appeal was taken from a judgment of conviction on three counts of burglary fixed by the verdicts as second degree, and from an order denying a new trial. Appellant admitted a prior burglary conviction in 1947 as alleged in the information, on which he served a term of imprisonment. In the instant case he was sentenced to the penitentiary.
