During the period from the first Monday in January, 1942, to the first Monday in January, 1946, appellant, C. B. Upton, served his second term as county attorney of Whitley County. He was re-elected for a third term at the November election, 1945, and this term commenced the first Monday in January, 1946. On November 12, 1945, as shown by an exhibit filed with the petition, the fiscal court entered an order allowing Upton the sum of $1000, "for services...
