This suit was brought by the Citizen's State Bank of Dickinson, Texas, as mortgagee under an automobile insurance policy with loss payable clause in its favor. The policy was issued by the defendant, American Fire and Casualty Company, on certain motor vehicles owned by the mortgagor, J. L. Langness.
