GLADNEY, Judge.

Invoking the provisions of the Louisiana Direct Action Statute, LSA-R.S. 22:655, the plaintiff instituted this suit to recover damages for personal injuries allegedly received on January 2, 1951, while a passenger in a taxicab insured by the defendant. He received severe injuries to his face, he alleges, when the operator of said cab attacked him. From an adverse judgment he has appealed.
