MADDEN, District Judge.

This is a motion to dismiss each of two counts of an indictment returned by the Grand Jury against the defendant, Anthony Valenti, alias Anthony Valentino, alias Tony Valentino.

The indictment and both counts thereof charge in effect violation of Section 1001 of Title 18 and it is set forth in the footnote1. The statute involved provides:

"Whoever, in any matter within the jurisdiction of any department...
