Defendant, Norman L. Kineston, was arrested for a violation of an ordinance of the Borough of Cambridge Springs. He was found guilty by a justice of the peace and an appeal was allowed to this court.

The ordinance provides that:

". . . no persons shall . . . without first having procured a license therefor . . . possess and operate, or permit the operation of, a vending...
