This action was commenced in the county court of Harmon county wherein the defendant, Roy Kizer, was charged by an information with having committed the offense of unlawful transportation of whiskey. Defendant was tried, convicted, and pursuant to the verdict of the jury was sentenced to serve the minimum sentence of 30 days in the county jail and to pay a fine of $50, and has appealed.
