POWELL, J.

Tommy Padgett appeals from a conviction in the court of common pleas in Tulsa county, where he was charged by information with the unlawful possession of intoxicating liquor. Having waived a jury, he was tried by the court. The defendant was sentenced to serve 30 days in jail, and to pay a fine of $100.

On February 6, 1951, counsel for defendant filed a motion to suppress the evidence. On March 22, 1951, the case was set for trial for April 2, 1951...
