On February 27, 1942, relator was sentenced by the County Court of Richmond County to an indeterminate sentence of from thirty to sixty years. He had been convicted by a jury in 1941 for robbery first degree and other offenses, and the judgment in 1942 superseded a prior definite sentence. It is undisputed in this habeas corpus proceeding that the relator himself made a motion in the County Court of Richmond on December 30, 1949, to vacate the sentence of 1942 for a failure...
