PEOPLE EX REL. NASSAU-BEEKMAN REALTY CORP. v. BOYLAND

279 A.D. 1064 (1952)

The People of the State of New York ex rel. Nassau-Beekman Realty Corporation, Respondent-Appellant, v. William E. Boyland et al., Constituting The Tax Commission of the City of New York, Appellants-Respondents. [132 Nassau St. and 15-17 Beekman St., Borough of Manhattan.]

Appellate Division of the Supreme Court of the State of New York, First Department.

May 20, 1952.

The basis of the application is that the order of this court fixed a value for the building of one of the parcels involved in the proceedings for the two years in issue in excess of the appraised value of the city's expert. While this is true, the total values found by the court were well below both the expert's total appraisal and below the assessed value. It is well established that the total assessment only is under review.
