In this action Hilke and his wife alleged that they were partners doing business under the name of Hilke Painting and Decorating Company. They alleged that they had a checking account at the Bank of Washington, which was carried on the bank records under the name of Hilke Painting and Decorating Company and either of the plaintiffs had a right to draw checks upon the account.
