The Chemical Corps of the War Department in October 1947 had for sale some 6,500,000 M5 protective ointment kits, left over from World War II. The contents of these kits were for the protection of soldiers against poison gas. The plaintiff was invited to bid for the kits, but its bid was rejected as being too low.
