Defendant was convicted of the crime of forgery in the second degree as a second offender on November 28, 1938, in the Jefferson County Court. At that time he was charged with being a second offender, to which he pleaded guilty. Theretofore he was indicted by the Grand Jury of the County of Broome in October, 1926, for the crime of forgery in the second degree to which indictment he entered a plea of not guilty.
