Under a written agreement, somewhat incomplete with regard to terms, plaintiffs agreed to purchase from the defendant certain premises known as The Hitching Post, together with the tavern business connected therewith. The sale was contingent upon the ability of the plaintiffs to obtain a liquor license from the New York State Liquor Authority, and also upon the ability of one of the plaintiffs to obtain a sufficient mortgage on his property in the city of Schenectady to purchase...
