The court finds the pertinent facts bearing upon the legal problems in this case to be as follows. In August, 1906 Trustees of Schools, Township 19, Range 6, of the County of Piatt and State of Illinois, pursuant to the statutes of the State of Illinois, filed a condemnation suit to take approximately two acres of land from the then owner, Henry L. Timmons "to be taken for a school site". The jury fixed the fair cash market value of the land...
