RIVES, Circuit Judge.
The District Court declined either to award the writ of habeas corpus or to enter a show cause order, but the Judge did issue the certificate of probable cause made necessary for this appeal by 28 U.S. C.A. § 2253. It cannot be doubted that the judgment is such a final judicial determination of the case as is reviewable here on appeal.
