Plaintiff appeals from a refusal of the trial court to grant him a judgment of recovery against a garnishee. His suit was originally filed on November 28, 1950 against Kinch Fennell on a promissory note. On January 6, 1951 judgment by default was entered on the claim for $746.96 with interest and costs and an attorney's fee of $75.
