Appellee, Irving Newcomb, Jr., was discharged from the Little Rock police force by the Chief of Police on July 17, 1950 for violation of Article 3, Section 9 of the Civil Service Rules and Regulations of the Police Department.1 The letter of discharge specifically charged, "* * * that you did on Saturday night, July 15, 1950 at approximately 7:45 p. m. strike a Negro man, Bud Beal, 702 Abeles, on the head with your slapper...
