Upon arraignment he entered a plea of not guilty and the indictment was removed to the Ulster County Court for trial. Counsel was assigned to represent the defendant and on April 11, 1940, the relator withdrew his former plea of not guilty and entered a plea of guilty. An information was filed against him by the District Attorney which charged him with being a second offender based upon a prior conviction for statutory rape in California.
