BUCHANAN, Justice.

The defendant, Roy, was convicted by a jury and sentenced to 90 days in jail on a warrant charging him with promoting and being concerned "in managing a lottery, towit, a numbers game," and having in his possession for the purpose of sale "a chance or ticket in or share of a ticket in said lottery." His trial in the circuit court was on appeal from a conviction by the county court.
