Plaintiff in Error, Albert Milton Powell, defendant below, was charged in the county court of Caddo, county, Oklahoma, with the offense of driving an automobile while under the influence of intoxicating liquor on public highway No. 62 in Caddo county on July 5, 1949. The defendant appeared for arraignment and he was advised as revealed by the court's minutes as follows, to wit:
