This is an appeal on questions of law from a judgment of the Probate Court of Delaware County. The facts as shown by the record are as follows:

Harry Irwin married Louise Pollock on June 25, 1942, and died April 10, 1951. Several weeks prior to his marriage to Louise Pollock, he gave her a diamond ring.
