Order modified on the law by (1) inserting after the word "denied" in the first ordering paragraph, the words "with respect to the first cause of action, but granted with respect to the second and third causes of action, with leave to plaintiff to plead over with respect to those two causes of action, if so advised"; (2) striking out the second ordering paragraph. As so modified, the order is affirmed, without costs.
