This appeal comes directly to this court from a decree of the circuit court of Henry County, entered in a partition proceeding. Through the renunciation of her husband's will, Cora E. Reighard acquired a fee-simple interest in certain real estate rather than a life estate as devised to her under the will. The validity of that renunciation is the issue here and a freehold is involved.
