Defendant and one Howard Richard Hodge were jointly accused of the offenses of burglarizing a house and stealing a television set. Both were before the court at the preliminary hearing. Hodge at that time testified against Green. As will appear later, Green did not deny having been with Hodge, but did deny that he knew that Hodge was taking a set that did not belong to him. Hodge testified at the preliminary that Green did know that the set was to be stolen...
