SMITH, Justice.

This is a suit for damages brought by petitioner, C. A. Lane, against respondent, the Fair Stores, Inc., for injuries sustained by petitioner's wife, Mrs. Mamie Lane.

Trial was before a jury and its answers to special issues were the basis for the entry of judgment in favor of petitioner. On appeal, the judgment was reversed and remanded by the Court of Civil Appeals at Amarillo.
