This is an action brought by virtue of the merchant seamen's act of June 5, 1920, ch 250, § 33 (41 Stat 1007, 46 USCA, § 688), known as the Jones act, against defendant, Nicholson Transit Company, owner of the steamship James Watt, for the death of Thomas C. Carroll on December 31, 1945.
