This is an appeal from a judgment of the Jefferson Circuit Court imposing the death penalty upon the appellant, Albert Shelkels, for the crime of armed robbery committed with the use of a deadly weapon which resulted in the death of Milton Zimmerman in Louisville, Kentucky, on December 23, 1948.
