On May 5, 1946, at about noon, the defendant, V.I. Whitney, rented a 1941 Chevrolet sedan to the decedent Irving Witte. The car had been acquired from Grays Harbor county by Mr. Whitney, who is an automobile dealer in Montesano, a few days previous to the accident giving rise to this case, and had been driven some eighty thousand miles by the county.
