By this suit against appellee, appellants seek to establish a trust against a house and lot located in the city of Austin, the record title to which is in appellee. Appellants alleged that appellee made an oral gift to Mrs. Davis of another house and lot, the proceeds from the sale of which were used, in part, in the purchase of the house and lot in issue, and, in part, is represented by a vendor's lien note.
