On December 6, 1950, the defendant, Kansas City Southern Railway Company, was engaged in burning dead grass and weeds on its 100 foot strip of right-of-way between its tracks and Lake Shore Drive in the 2200 block of Lake Shore Drive. While the burning of this strip was in progress a gusty wind was blowing at irregular intervals, carrying smoke of varying density...
