MILLER, Justice.

On January 22, 1947, about 4:00 o'clock p.m., an Oldsmobile sedan, owned and driven by J. C. Sheffield, was struck by a train of the Atlantic Coast Line Railroad Company, plaintiff in error, at a grade crossing on U. S. Route 60 near the city of Richmond, Virginia. The driver and Edrie Bowen, an occupant of the car, were injured and the automobile almost demolished.
