This action grew out of an agreement for the construction by the appellee of 1,548 square yards of pavement at the price of $1.25 a yard. In the complaint there was set out a contract for the performance of which the appellee claimed $1,935, and there was incorporated a count for money due to cover work done and materials furnished to the appellant.
