DONWORTH, J.

This is an appeal from a judgment awarding damages to plaintiffs in an action based on fraudulent misrepresentations in connection with the leasing of a resort property. At the conclusion of the first trial of this case, to the court sitting without a jury, judgment was entered for defendant. Plaintiffs appealed from that judgment.
