BARNES, J.

Defendant has been convicted before a Police Justice of violation of section 14 of the ordinances of the Village of Johnson City, New York. This ordinance so far as it is pertinent here is as follows:

"Section 14, Resisting an Officer — It shall be unlawful for any person to harm, obstruct or resist any officer of the Village of Johnson City in the performance of any duty required...
