We will herein refer to the parties as they appeared in the trial court where plaintiff in error was plaintiff and defendant in error was defendant.

November 1, 1947, plaintiff and defendant entered into a written agreement under the terms of which plaintiff contracted to convey certain lands to defendant and to deliver to it "good and sufficient assignments" of lessee's interest in certain state lands held under lease from the State of Colorado...
