SPRATLEY, Justice.

Henry F. Dudley brought this action against Paul W. Guthrie and Roanoke Ready Mix Concrete Corporation to recover damages for injuries alleged to have been caused by defendants' negligence. The case came on to be tried, and at the termination of the taking of the evidence on behalf of all parties, the trial court sustained defendants' motion to strike out the evidence of the plaintiff.
