ADAMS, Justice.

This is an action of contract to recover insurance on a horse. It was heard in the Chittenden Municipal Court. Trial was by court on an agreed statement of facts and stipulation. Judgment was for the plaintiff. The case is here on the defendant's exceptions.

It appears from the agreed statement of facts that the plaintiff was the owner of a horse which he insured with the defendant company on June 3rd, 1948, for one year in the amount of $400...
