The plaintiff in his brief in support of his motion for reargument says that there are three general grounds in the motion. The first of these is that the jury properly could have found that the plaintiff's conduct and negligence, if any, were no part of the proximate cause of the accident and that there was a time when the defendant could and the plaintiff could not have avoided the accident.
