These two cases will be considered together since the charges grew out of the same episode, appellants were tried together and their appeals are here on the same trial transcript.

Each appellant was charged in a separate amended information with the crime of murdering one William James Bailey on August 20, 1949. A jury convicted them of murder of the second degree and judgments were entered accordingly...
