Susie Ryland Harlow (appellant) while riding as a guest in an automobile, owned and operated by her nephew, George Ryland (appellee), received personal injuries. She sued for damages in Federal Court. Appellee filed motion to dismiss (which was treated as a demurrer) since the complaint admitted the relationship of the parties to be that of aunt and nephew and therefore within the third degree of relationship by consanguinity or affinity.
