Humkey (hereinafter called plaintiff) from a judgment in bar of his cause of action and against said plaintiff for costs, rendered on the verdict of a jury in a case which had been instituted by plaintiff against defendants-appellees, Hueslmann Quarry, Inc., a corporation, and Arthur Hoerchler (hereinafter called defendants).
