Appellant was convicted of grand larceny through the theft of an automobile, February 13, 1947.

Smilanich, owner of a 1941 Chevrolet Club coupe, the automobile in question, left it unlocked in the parking lot before the Circle M, some kind of a business establishment on Highway 30 a mile or two west of Boise in Ada County.
