This litigation had its inception in June, 1947, incident to the filing of a claim by Louis M. Nims, commissioner of the department of revenue, against the estate of Judd A. Straight, deceased. On appeal to the circuit court the claim was allowed in the amount of $8,171.12. The executor of the estate, Leroy F. Straight, has appealed.
