WEISS, J., December 5, 1951.

Plaintiff's complaint is an action of mandamus against Charles F. Dinan, Treasurer of Allegheny County, praying for judgment against defendant, compelling defendant to deliver a warrant of the State Treasurer of the Commonwealth of Pennsylvania in the amount of $8,509.03 to plaintiff. Defendant filed an answer, whereupon plaintiff moved for judgment on the pleadings. The matter now comes before this court en banc on this motion.
